The purpose of this contract is to define the rights and obligations of the parties in connection with the sale, use, and subscription to WimSport services, including digital services intended for the management of sports clubs, gyms, associations, and sports organizations.

3. Definitions

For the purposes of these terms, the following expressions shall have the meanings set out below: • “WimSport”: the platform, website, and services offered under the WimSport brand. • “Customer”: any natural or legal person who orders or uses WimSport services. • “Service”: any service, feature, software solution, or subscription offered by WimSport. • “Order”: the act by which the Customer requests the purchase, activation, or subscription to a WimSport service.

4. Services

WimSport provides digital services designed to facilitate the management of sports activities, including members, subscriptions, payments, disciplines, attendance, communications, and administrative operations. WimSport reserves the right to modify, improve, or withdraw certain features in order to maintain and improve the quality of its services.

5. Placing an Order

After selecting the service or subscription of interest, the Customer may validate the order through the website or any other channel accepted by WimSport. The Customer undertakes to provide accurate and complete information. In the event of an error when placing the order, the Customer is invited to contact WimSport as soon as possible to request correction or cancellation.

6. Prices

Prices for WimSport services are indicated in Moroccan dirhams unless otherwise stated. The applicable prices are those in force at the time of the order or subscription. WimSport reserves the right to modify its prices at any time, without retroactive effect on orders already confirmed, unless otherwise agreed between the parties.

7. Order Execution

WimSport undertakes to activate or provide the ordered service as soon as possible after confirmation of the order or payment, depending on the nature of the requested service. In the event of unavailability or technical difficulty, the Customer will be informed so that an appropriate solution can be agreed.

8. Delivery or Activation

As WimSport services are mainly digital, delivery corresponds to the activation of the account, subscription, or access to the service. The Customer is responsible for maintaining the confidentiality of access credentials and for any use made through the account.

9. Payment Method

To pay for the order, the Customer chooses the payment method from those offered by WimSport. Online payments, when available, are processed through secure platforms. The Customer guarantees that he or she has the necessary authorizations to use the selected payment method.

10. Data Confidentiality

The information requested from the Customer is necessary for processing the order, activating the services, and managing the commercial relationship. WimSport undertakes to treat this data confidentially and to use it only within the scope of the services provided.

11. Right of Withdrawal

The Customer may request cancellation of an order or subscription according to the applicable commercial conditions and the nature of the service provided. For digital services that have already been activated or used, refunds may be limited or excluded, unless otherwise agreed or required by applicable law.

12. Warranty and Support

WimSport undertakes to provide its services professionally and to offer reasonable support in the event of difficulties related to the use of the platform. The warranty does not cover damage or malfunction resulting from misuse, unauthorized access, poor Internet connection, or third-party services beyond WimSport’s control.

13. Proof of Transactions

Data recorded by WimSport systems, including orders, subscriptions, payments, activations, and usage history, constitutes proof of transactions between the Customer and WimSport, unless proven otherwise.

14. Force Majeure

WimSport shall not be held liable for any delay or inability to perform its obligations when a force majeure event or any event beyond its control prevents the normal execution of the service.
